Mandatory Guidelines for Machine Owners

Guidelines:

1️⃣ Immediate Dismissal of an Operator is Illegal

• Terminating a machine operator suddenly without prior notice is against labor laws.
• If it is necessary to remove an operator, a written notice must be given at least one month in advance to both the operator and the foundation.
• If the dismissal is due to indiscipline or misconduct, a prior notice must be issued, and the foundation must be informed to ensure a fair investigation.

2️⃣ Timely Salary Payment is Mandatory

• The machine owner or company must pay the operator’s salary between the 1st and 10th of every month.
• If payment is not made after the 10th, a penalty of ₹500 per day will be applicable.

3️⃣ Operator’s Health and Safety Responsibility

• If an operator falls ill during work, it is mandatory for the company/owner to arrange for their treatment.
• In case of a workplace accident, the company/owner will be responsible for full medical care and compensation.

4️⃣ Appointment of a Helper is Mandatory

• Every machine owner and company must ensure that a helper (assistant) is available for each operator.

5️⃣ Driving License is Mandatory

• Making an operator run a machine without a valid license is a legal offense.
• The operator must have a valid license for the specific machine they are operating.
• If any company or owner allows an unlicensed operator to run a machine, it will be considered a punishable offense, and the foundation will be compelled to take legal action.

6️⃣ Contract (Agreement) Between Operator and Owner is Mandatory

• A written contract (Agreement) between the owner/company and the operator is mandatory.
• It is recommended that operators be hired through the foundation to ensure their rights are protected.

Conclusion:

If any company, contractor, or owner violates labor laws or tries to enforce unfair practices, the Operator Ekta Sahayata Foundation will be compelled to take legal action.
